These Terms of Service (“Terms”) govern your use of Evidencestack. By using our service, you agree to these Terms. If you don't agree, please don't use the service.

The service

Evidencestack is a software platform that helps technology companies document their R&D activities for tax credit purposes. We connect to your development tools (such as GitHub, GitLab, Jira, and Linear) to analyse development activity and generate technical narratives.

Pilot Status: Evidencestack is currently in private pilot. The service may change, features may be added or removed, and there may be occasional downtime or bugs. We appreciate your patience and feedback as we improve the product.

Your account

  • You are responsible for maintaining the security of your account credentials
  • You must have authority to connect your company's repositories and project management tools
  • One account per person; accounts are not transferable
  • You must provide accurate information when creating your account

Your data and intellectual property

Your code remains yours. We claim no ownership over your source code, repositories, or any other intellectual property. You retain all rights to your work.

By connecting your development tools, you grant Evidencestack permission to:

  • Access and analyse commit messages, PR descriptions, and ticket information
  • Generate R&D documentation based on this information
  • Store this data securely for the purpose of providing the service

You can revoke this access at any time through your account settings or directly in your connected platforms.

Acceptable use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the service
  • Interfere with or disrupt the service
  • Reverse engineer or attempt to extract the source code
  • Use the service to generate fraudulent R&D claims
  • Share your account credentials with others

Important disclaimers

Evidencestack provides documentation support, not tax advice. The narratives and documentation generated by our platform are intended to support your R&D tax credit claims, but they do not constitute tax, legal, or financial advice. You are responsible for ensuring your claims comply with HMRC requirements.

We recommend working with qualified tax advisors to review your claims before submission. Evidencestack is not liable for the outcome of any R&D tax credit claims.

Payment and pricing

During the pilot period, access to Evidencestack is provided free of charge. Future pricing will be communicated before the end of the pilot period. You will not be charged without prior notice and agreement.

Limitation of liability

To the maximum extent permitted by law, Evidencestack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Loss of data
  • Rejected or reduced R&D tax credit claims
  • Business interruption

Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim.

Termination

Either party may terminate this agreement at any time. You can close your account through the platform settings or by contacting us.

Upon termination, your access to the service will end and your data will be deleted within 30 days, unless we are required to retain it for legal purposes.

Changes to these terms

We may update these Terms from time to time. We will notify you of any material changes by email or through the platform. Continued use of the service after changes take effect constitutes acceptance of the new Terms.

Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
